PicallEx LLC, is the controller of your personal data, as described in this privacy policy, unless otherwise specified.
In this privacy policy (hereinafter, the “Policy“) we explain exactly and in detail how we collect, use and process your personal information and that of your customers when you browse our website, and use the PicallEx services (hereinafter, the “Services“).
INFORMATION AND PERSONAL DATA
Personal information that You and/or Users provide to PicallEx through the Service is governed by this Policy. You are responsible for maintaining the confidentiality of your username, password and other confidential information.
For the purposes of this Policy, personal data refers to any information related to an identified or identifiable person (hereinafter, the “Personal Data”)
This Policy explains our practices (and your choices) regarding the collection, use, and disclosure of certain Personal Data, as well as your information in connection with the Services.
BEFORE BROWSING AND/OR USING THE SITE AND/OR THE SERVICES, PLEASE READ THIS PRIVACY POLICY CAREFULLY. IF THE CLIENT DOES NOT AGREE WITH THIS PRIVACY POLICY, THEY MUST REFRAIN FROM USING THE SITE AND/OR THE SERVICES.
PicallEx represents that it will organize information provided by the Client or Service Data according to its own internal criteria and policies. PicallEx assumes no responsibility, nor does it provide the service, to categorize, tabulate, or structure information according to guidelines provided or requested by Clients; accordingly, PicallEx does not guarantee the availability of Service Data in a specific organized form. PicallEx may, at the Client’s request and under certain requirements, deliver information or Service Data in an organized form, in which case a fee determined at PicallEx’s discretion may apply. PicallEx will offer the option to export Service Data, provided that the provisions set forth in this Policy and the applicable Terms are met.
The privacy and security of your personal information are and always will be of the utmost importance to PicallEx. For this reason, we want to transparently explain to you the controls and options available to you regarding how and when you share your personal information. By accepting the PicallEx Terms, you understand that we will collect and process your personal information as described in this Policy. All capitalized terms that are not defined in this Policy will have the same meaning assigned to them in the Terms.
In order to reflect changes in our practices, we will update this Policy from time to time. In such a case, we will update the “effective date” at the top. If the changes are substantial, we will provide more formal notice by reasonable means, by means of a conspicuous notice on our website or, where required by applicable law and practicable, by contacting you directly.
We encourage you to periodically review this Policy to stay informed about the collection, processing and sharing of your personal information. We will archive previous versions of this Policy for Your review.

When this Policy does not apply: Third Party Websites:
The PicallEx website may contain links to other websites. The information practices and content of those websites are governed by the privacy statements of those websites. PicallEx does not control and is not responsible for the privacy and data collection policies of such third-party sites and services. We encourage you to review the privacy statements of those websites to understand their information practices.
INFORMATION WE COLLECT
When you interact with PicallEx through our websites or when you use the Services or the Application, we may collect Personal Data and other information, as described below. We only collect the information that we really need. Some of that information is information that You actively provide to us when You register for an account, to create and manage Users, at an event, request customer support, or purchase any Service.
When you visit one of our websites or use our software, we automatically record certain basic information, such as how you got to the site, where you navigated within it, and what features and settings you use. We also store data relating to visitors to our websites or participants in our events, and any other potential customers and/or users (collectively, “Prospects“) who visit our website or otherwise interact with our Services, website, content, digital advertisements, emails, integrations, or communications under our control. If you provide us with your Personal Data, you agree that it will be truthful and that you must notify PicallEx of any changes, being responsible for the truthfulness and accuracy of the data provided at all times. The person who provides their Personal Data to PicallEx declares that they are of legal age and is fully responsible for this declaration.
On our websites
We collect personal information from you when you submit web forms to us or interact with our sites; we record the information you submit when you (i) register for any event, including seminars, (ii) subscribe to our newsletter or any other mailing list, (iii) submit a form to download any product, white paper or other material, (iv) enter contests or respond to surveys about the knowledge of our Services and the experience of using the platform, or (v) submit a form to request customer support or to contact PicallEx for any other purpose. (vi) when you interact with us on social media, blogs. (vii) when you contact PicallEx by other means such as telephone, email, postal mail or fax (viii) when you download the Application. We may ask both the Prospects, You and/or your Users: email address, first and last name, position and other commercial information related to the entity you represent, such as billing address, industry you are in, the number of employees or agents you have within your organization and other related information. You can freely explore some sections of our site without having to provide Personal Data.
User and account information:
We collect Personal Data when You open a PicallEx account, create or modify your user information, set preferences or provide other information related to accessing or using our Service (such as name, email address, phone number, payment information and physical address, among others). We collect Personal Data about Users from their account, such as name and email address, phone number, online username(s), and other similar data that PicallEx stores to, among other things, communicate with Users in connection with the provision and support of the Services. Users’ contact information is not considered Service Data. PicallEx will be the data controller of its Users’ contact information and will process such Contact Information in accordance with this Privacy Policy. The Customer is responsible for informing its Users of their rights set forth in this PicallEx Privacy Policy. The Customer represents and warrants that it has obtained all relevant consents, permissions, and rights and provided all relevant notices required under applicable data protection laws for PicallEx to lawfully process Users’ contact information as the controller for the purposes set forth herein. You can choose not to provide certain information, however, if you do, you will not be able to take advantage of many of the features that PicallEx offers you.
Payment information:
We collect payment and billing information when You sign up for paid products or services including preferences, such as purchasing history or trends and transaction information.. For example, we might ask for a billing address or contact for the PicallEx account. If you provide us with this information, we will use it only as authorized by you under this Policy. You may also provide payment information, such as bank account or data of credit card numbers, when You purchase Services. We use third-party payment service providers to manage the processing of payments. For expedited processing of future payments, if you have given us approval, we may store your credit card information or other payment information on the secure servers of our payment gateway service providers.
Any information described above and provided directly by You is referred to as “Account Information” for purposes of this Policy. By voluntarily providing Account Information to us, you represent that you are the owner of such Personal Data or otherwise have the necessary consent to provide it to us.
Mobile app:
When you download and use our Services, we automatically collect information such as the type of device you use, the version of the device’s operating system, the mobile operator that facilitates the connection to the mobile application and the country from which the connection comes, to fulfill our obligations under our Terms.
Usage information:
We collect information related to how You and Users use the Services, including including the actions that are carried out on Your account (such as sharing, editing, viewing, creating, and moving files or folders). We may also record, analyze and use your interactions with PicallEx, including email, phone and chat conversations with our sales and customer service professionals, to improve our interactions with you and other Customers. We use this information to provide, improve, and promote our Services, and to protect PicallEx users.
Device information.
We also collect information about the devices You and its Users use to access the Services, to the website and/or the Application and information about those devices. This includes IP addresses, the type of browser and device you use, the web page you visited before accessing our sites, and identifiers associated with your devices. Devices (depending on settings) may also transmit information about your location to the Services. For example, we use device information to detect abuse and identify and fix bugs. When you visit our websites, we collect information that web browsers, mobile devices and servers make available, such as language preference, time zone, referring URL, access date and time, operating system, device manufacturer mobile and mobile network information. We include them in our log files to understand more about visitors to our websites.
Information from public sources
This includes information from public records and information you share in public places, such as social media.
Cookies and other technologies
We use certain technologies, such as cookies and pixel tags, to provide, improve, protect, and promote our Services. For example, cookies help us to remember your username on your next visit, to understand how you interact with our Services, and for additional purposes, such as:
- Recognize you when you sign in to use our services. This allows us to provide you with product recommendations, display personalized content, and provide other personalized features and services.

- Conduct research and diagnostics to improve PicallEx content, products, and services.

- Reporting. This allows us to measure and analyze the performance of our services.
You can set your browser to not allow cookies, but this may limit your ability to use the Services. The Help function of most browsers tells you how to set your browser to not accept cookies, to notify you each time you receive a new cookie, or to turn off all cookies. If you disable all cookies in your browser, neither PicallEx nor third parties will transfer cookies to your browser. However, if you do so, you may have to manually adjust some preferences each time you visit a site and some features and Services may not work.
Authorized third parties may also set cookies when You interact with the PicallEx Services. Third parties include search engines, measurement and analytics service providers, and social networks.
Information we collect from third parties
Information from social networking sites and other publicly available sources: When you interact with us on social networking sites such as Facebook, Twitter, Google+ and Instagram through posts, comments, questions and other interactions, we may collect such publicly available information, including information profile, to allow us to connect with you, improve our products, or better understand user reactions and issues. PicallEx may also aggregate and update information about You from other publicly available sources. We may obtain other information from third parties, including Personal Data, and may combine it with information we collect through our Websites. For example, we may have access to certain information from a third-party authentication or social networking service if you connect to our Services through that service or otherwise provide us with access to information from the service. Any access we may have to such information from a third-party authentication or social networking service is done in accordance with the authorization procedures determined by that service. You will need to check your privacy settings on these third-party services to understand and modify the information sent to us through these services.
Information of service providers:
If you register for or attend a PicallEx-sponsored event, the event organizer may share your information with us. PicallEx may also receive information about You from review sites if You comment on any reviews of our products and services.
Information we process on behalf of our clients
When Customers use the Services, they may collect personal data, such as first and last name, email address, postal address and telephone number from third parties electronic data, means of contact, background and purchase information, communications, among other information or other materials sent to and stored within the Service by Customers (the “Service Data”). We do not control the content of our customers’ web pages or the types of Personal Data they may want to collect or manage through the Services. Customers are solely responsible for the accuracy, content and legality of all data they process through the use of the Services.
Customer may transmit or post content created using any of the Services or otherwise. However, the Client will be solely responsible for said content and the consequences of its transmission or publication. You are responsible for ensuring that you do not accidentally make any private content available to the public. While using any of the Services, if you encounter any content with copyright notices or copy protection features, you agree not to remove such copyright notices or disable such copy protection features. By making any copyrighted content available on any of the Services, you affirm that you have the consent, authorization or permission, as the case may be, of each person who may claim any right in such content for such content is available that way.
We store our Clients’ information on the servers of the service providers we use, but we process it at the Clients’ instructions and in accordance with our Terms, which prohibit us from using it except as necessary to provide and improve the Services and in accordance with what the law establishes.
Our Clients are responsible for correcting, deleting, or updating information they process through the Services and for complying with any regulations or laws that require notice and information to be provided and consent to be obtained before Personal Data is transferred to PicallEx for marketing purposes. prosecution.
Notice to End Users
The Services are intended to be used by businesses. An End User is any person other than the Customer or a User authorized by the Customer. End Users interact with You or Your Users while the Services are being performed.
When our Services are made available through a Customer, the Customer is the data controller of Personal Data from its customers (End Users). Your questions and requests regarding privacy as an End Users should initially be directed to the PicallEx Client in its capacity as data controller. PicallEx is not responsible for the privacy or security practices of Clients, which may differ from this Policy.
PicallEx Clients can do the following:
- access and describe the Personal Data you provided to them;
- access and export your Personal Data processed by them;
- modify your Personal Data, including your end user profile.
Customers may entrust the information they control to PicallEx in connection with the use or the Services. This includes information about your customers (end users) and your employees (if you are a controller). PicallEx processes this information in the capacity of processor and according to the instructions of the Clients. Please refer to the Customer data processing agreement for more information.
PicallEx obtains address information from Clients, and has no direct relationship with the individuals whose Personal Data it processes in connection with Clients’ use of the Services. Use of information obtained through our Services will be limited to the purpose of providing the Service for which Clients have engaged PicallEx. If you are an individual interacting with a Client using our Services and require assistance or wish to change your contact information, please contact the Client you interact with directly.
RETENTION OF PERSONAL INFORMATION
Regarding the retention period of your data, it will be consistent with the original purpose for which it was collected. The length of time PicallEx retains the information it collects depends on the type of information and the mechanisms used to collect and store it. Where PicallEx is the data controller of Personal Data (for example, personal data related to Website visitors, personal data of Users, attendees and people who register to use our Services), it retains Personal Data that is collected when there is a need legitimate and ongoing business to do so (for example, to provide you with our Services, to ensure payment of balance owed, to enable your participation in an event, and to comply with applicable legal, tax, or accounting requirements) or a legal obligation to preserve.
Where we have no ongoing legitimate business need to process your Personal Data, we will delete or combine it or, if this is not possible, then we will store your Personal Data securely and isolate it from any further processing until deletion is possible.
If your Personal Data is processed under a Client’s Account Information, we will process the Personal Data for as long as the relevant Client, who is the data controller, indicates to us.
If you have opted in to receive marketing communications from us, we will retain information about your marketing preferences for a reasonable period from the date you last expressed interest in the content or Services. We retain information from cookies and other tracking technologies for a reasonable period from the date such information was generated.
HOW WE USE YOUR INFORMATION
We use Personal Data as necessary for the performance of our Services (“Performance of Contract”); to comply with our legal and contractual obligations (“Legal Obligations”) and in support of our legitimate interests to maintain and improve our Services. We may use the information we collect about Prospects, You, and/or Your Users (including Personal Data, to the extent applicable) to carry out our obligations under the Terms, including (a) providing, developing, maintaining, improve and promote the Services; (b) allow you to access and use the Websites and the Services; c) set up and maintain your account, and take all other actions necessary to provide our Services, such as enabling collaboration, providing website and mail hosting, and backing up and restoring your data; (d) process and complete transactions for billing, account management and other administrative matters; (e) for internal business purposes, reporting and accounting functions, auditing and managing projects related to our Services, performing IT security management, evaluating our business, and researching and developing new services; (f) send transactional messages, including responses to your comments, questions and requests; provide customer service and support; send you technical notices, updates, security alerts, and support and administrative messages and communicate with you about products you have downloaded and services you have registered for or important notices; (g) send PicallEx information or content that we think may be of interest to you by posting, email or other means, and send marketing communications related to our company; (you can opt out of receiving marketing communications and provide the names/email addresses you wish to be removed from our marketing databases and added to our “Do Not Contact” list or follow the unsubscribe instructions included) in our marketing communications); (h) process and deliver contest or sweepstakes entries and prizes; (i) monitor and analyze trends, usage and activities in connection with the Websites and Services and for marketing or advertising purposes; (j) investigate and prevent fraudulent transactions, unauthorized access to the Websites and Services, and other illegal activities; (k) customize the Websites and Services, including providing features or advertisements that are tailored to your interests and preferences, (l) to better understand how you, our Users, and Prospects evaluate, use, and interact with our Services, and based on that information, continue to improve our Services, overall performance, user experience, and the value generated from it; (m) to send notifications related to our customer terms of service and other legal agreements; (n) to improve our Services by training the models that power our developments using artificial intelligence (“AI“). You may object to the use of your information for training our AI models by informing PicallEx in writing of your decision. The Client accepts that in such circumstances, PicallEx’s ability to provide its Services may be limited and that some features and Services may not function; and (ñ) for other purposes for which we obtain your consent.
If you use the PicallEx App, we may occasionally send you push notifications to keep you up to date about current events or promotions. If you wish to stop receiving these notifications, you can disable them from your device. We may contact you by phone to inform you of other PicallEx products or services that may be of interest to you. If you have a scheduled call with a PicallEx representative, we may record and transcribe it. In this case, we will notify you in advance so that the recording may not be carried out, if you so desire.
If required by law, we will only send marketing communications with your consent. Otherwise, we will advertise and market our products and services based on our legitimate business interests. We receive information from third-party service providers and other sources, such as third-party business information providers and public sources. We may receive and use this information in combination with other information we collect through other means, as described in this Policy. We will do this with the goal of updating and improving the subscription service, including personalized communications, event promotions, and website or product modifications to optimize your experience.

Third Party Service Providers:
We share information, including Personal Data, with our third-party service providers that we use to provide hosting and maintenance for our Websites, application development and new products or services, backup, storage, payment processing, analytics, and other services for us. These third party service providers may have access to or process your Personal Data in order to perform these services for us.
Similarly, PicallEx may use certain technology from third-party service providers in some of its AI developments. You agree that the data you incorporate into the Services—including personal data in an anonymized, de-identified form, or aggregated with aggregation techniques—may be shared with third-party service providers to provide and/or improve the Services, and we will not attempt to reverse such dissociation unless required to do so by law.
We may collect and contract with third-party analytics providers to compile metrics and information regarding your use of the Service, including evaluating how Customers use the Service (“Usage Data”), to develop new features, improve current functions or inform sales and marketing strategies.
Employees and Independent Contractors:
Certain PicallEx employees and independent contractors have access to personal information when they need it. Professional advisors, such as lawyers, accountants, and auditors we hire, may also have access to this information. We require all employees and independent contractors of PicallEx entities to follow this Policy for the personal information we share with them.
Law Enforcement and Law Enforcement Requests:
In certain situations, we may be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may disclose Personal Data to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms, or as otherwise required by law. law.

PicallEx Group Information Exchange:

Additionally, in the event of a change in control of PicallEx or any of its subsidiaries, whether through a merger, acquisition, or purchase of a substantial portion of its assets, your Personal Data may be disclosed to the parties involved. If we believe such a change of control could materially affect your stored Personal Data, we will notify you and inform you of the available options by email or through a prominent message on our Services.
Business transfers:
In connection with a reorganization, restructuring, merger or sale, or any other transfer of assets, we will transfer information, including personal information, provided that the recipient agrees to honor your personal information in accordance with our Policy.
HOW INFORMATION IS TRANSFERRED INTERNATIONALLY
We do not share your Personal Data with third parties, except as necessary to carry out your request, for our legitimate professional or business needs, or as required or permitted by law. In the event that we transfer your Personal Data to third parties or service providers, appropriate measures will be taken to ensure correct and secure processing of the information in compliance with the applicable legislation on data protection.
To facilitate our global operations, we may transfer and access such Personal Data from other countries in which the PicallEx Group operates.
SECURITY OF THE INFORMATION
We have taken steps to implement appropriate administrative, technical, and physical safeguards to prevent unauthorized access, use, modification, disclosure, or destruction of the information you entrust to us.
- Confidentiality. We use various physical and logical measures to protect the confidentiality of customers’ Personal Data. Those measures include:
Physical security: Physical access control systems in place (badged access control), surveillance systems, including alarms, clean desk policies and controls (lockout of unattended computers, locked cabinets, etc.), security management visitor access.
Access control and prevention of unauthorized access: user access restrictions; access permissions o implemented and role-based provided/reviewed based on segregation of duties principle, strong authentication and authorization methods (multi-factor authentication, certificate-based authorization, etc.), centralized password management and strong/complex password policies ( minimum length, character complexity, password expiration, etc.)
Encryption: Encryption of external and internal communications, remote connections to company networks are encrypted via VPN.
- Integrity. Appropriate record and change management controls and access controls are in place to help maintain the integrity of personal data, such as:
Logging and monitoring: logging of access and data changes, centralized auditing and security logs
- Availability. HOW TO ACCESS AND MANAGE YOUR PERSONAL DATA
If you are the owner of Personal Data, you have the following rights with respect to the information that PicallEx has about you.
Right of Access: You have the right to access (and obtain a copy, if necessary) the categories of personal information we hold about you.
Right of rectification: You have the right to update the information we hold about you or rectify any inaccuracies. Depending on the purpose for which we use your information, you may direct us to add additional information about you to our database.
Right to erasure: You have the right to request that we erase your personal information in certain circumstances, such as when it is no longer needed for the purpose for which it was originally collected.
Right to restriction of processing: You may also have the right to request restriction of the use of your information in certain circumstances, such as where you have objected to our use of your data, but we need to check whether we have compelling legitimate grounds for such use.
Right to object: You have the right to object to the use of your information in certain circumstances, such as the use of your personal information for direct marketing.
Right to make a complaint: You have the right to make a complaint to the relevant supervisory authority if you have a complaint against the way we collect, use or share your information. This right may not be available to you if there is no supervisory authority dealing with data protection in your country.
Some registered users can update their user settings, profiles and company, and event registrations simply by connecting to their accounts and editing their settings or profiles.
To update your billing information, cancel your account, or request the return or deletion of your Personal Data and other information associated with your account, please contact us. We will respond to these requests within a reasonable time. Please note, however, that we may need to retain certain information to maintain records, complete transactions, or comply with our legal obligations.
UNSUBSCRIBE FROM OUR COMMUNICATIONS
As indicated in the “How We Use Your Information” section, you may unsubscribe from our marketing communications through one of the following methods:
By clicking the unsubscribe link at the bottom of our emails or by changing your communication preferences. The Client cannot request that PicallEx stop sending transactional emails related to the account or the contracted Service.
To unsubscribe from Client communications: Please note that PicallEx Clients are solely responsible for the marketing emails and other communications they send, so we cannot decide whether to unsubscribe or configure their communications.
DATA SUBJECT REQUESTS
If you believe that we store, use or process your information on behalf of one of our Clients, please contact the client if you wish to access, rectify, erase, restrict or oppose the processing, or export your personal data. We will extend our support to our Client to respond to their request within a reasonable time. If you wish to make your request directly to us, please provide us with the name of the PicallEx client who sent us your data. We will transfer your request to said client, and we will offer you the necessary support to respond to your request within a reasonable period of time.
MINORS
Our Services are not directed to children. We do not knowingly collect personal information online from children under the age of 13, or any other age as required by applicable law. We do not knowingly collect Personal Data from children unless (a) we have obtained the consent of a parent or guardian, (b) such collection is subject to a separate agreement with us, or (c) the visit of a child /a minor has not been requested or is accidental. We encourage parents and legal guardians to monitor their children’s use of the Internet and to help enforce this Policy by instructing their children never to provide Personal Data through the Websites or Services without their permission. If you are a parent or guardian and you believe that your child has provided us with Personal Data without your consent, please contact us, and we will take steps to remove the Personal Data from our systems.
COMPLIANCE WITH THE PRIVACY POLICY
We make every effort, including periodic reviews, to ensure that the personal information you provide is used in accordance with this Policy.
